Exclusive: A fresh twist allows Everton to be deducted two points – Wyness
Former Everton CEO Keith Wyness believes that Everton has grounds to potentially reduce their second points deduction to just two points by invoking the concept of double jeopardy.
Wyness, who served as CEO at Goodison Park from 2004 to 2009 and now advises
elite football clubs through his consultancy, highlighted that Everton has already been
penalized for two of their last three financial accounts.
Following a successful appeal that saw their initial 10-point deduction reduced to six
points due to acknowledged “legal errors,” Everton faces a second
hearing after being charged with exceeding allowable
losses of £105 million again based on their 2022-23 accounts.
It’s expected that Everton could receive a further six-point deduction from this
second hearing, bringing the total punishment to 12 points.
Wyness contends that Everton will argue double jeopardy, considering that their financial
accounts for the years under scrutiny have already been assessed and penalized in their initial charge.
He suggests that given this legal principle, Everton may be able to reduce their potential
second points deduction to a third of its original size, potentially resulting in
just two points being deducted.
Wyness emphasizes that the mitigating circumstances surrounding Everton’s
case should be carefully considered in determining the appropriate penalty.
